West Virginia State Police say the suspect in a fatal shooting in Institute has been taken into custody.

Juan Chic, 29, turned himself into Charleston police Saturday and was charged with first-degree murder, according to a criminal complaint filed in Kanawha County Magistrate Court.

State police said Andre Leonard, who was in his mid-to late-20s, was fatally shot at about 6:10 p.m. Wednesday at the intersection of Elm and Wheatley streets.

The complaint said a witness saw Leonard approach a silver Chrysler 300 with a man inside, then the man shot Leonard. Investigators spoke with Chic’s girlfriend and she confirmed she was with Chic at the time of the shooting inside the car.

Chic's mother told Eyewitness News she does not believe her son committed murder and believes he is innocent. She said the father of two daughters is a "good, sweet kid who stays to himself. "

Chic is being held in the South Central Regional Jail without bond. A preliminary hearing has been set for 1:45 p.m. on August 27.
