I TENNIS MAYNARD HEARING
JUDGE FERRELL HELD A STATUS HEARING EARLIER THIS AFTERNOON... TENNIS MAYNARD DIDN'T SHOW UP IN PERSON... BUT HE WAS THROUGH A VIDEO CONFERENCE FROM JAIL.

BACK IN APRIL, POLICE SAY TENNIS MAYNARD SHOT AND KILLED SHERIFF EUGENE CRUM WHILE HE SAT IN HIS CAR EATING LUNCH IN DOWNTOWN WILLIAMSON. MAYNARD WAS THEN CAUGHT AND SHOT BY A DEPUTY IN DELBARTON. DURING THE LAST HEARING INVOLVING MAYNARD'S CASE, HIS FATHER, MELVIN MAYNARD TOLD EYEWITNESS NEWS THAT TENNIS SHOT CRUM BECAUSE CRUM ALLEGEDLY RAPED HIM WHEN HE WAS YOUNGER. DURING TODAY'S HEARING... MAYNARD WAVED HIS RIGHT TO A FAIR AND SPEEDY TRIAL. A NEW PROSECUTOR OUT OF KANAWHA COUNTY, MARK PLANTS IS NOW OVER THE HIGH PROFILE CASE... AND SAYS EVEN THOUGH IT'S HIGH PROFILE... THAT SHOULDN'T HURT MAYNARD'S CHANCES OF HAVING A FAIR TRIAL.

"Every case has its difficulties, but every case from a prosecutor's perspective, you take the evidence that you have and you move forward, and you make sure that it's admissible, and you prepare for trial, and this case is no different."

SO, NOW IT'S A CASE INVOLVING THREE COUNTIES... YOU HAVE A CABELL COUNTY JUDGE, WITH A KANAWHA COUNTY PROSECUTOR AND THE TRIAL IS SCHEDULED IN MINGO COUNTY... BUT THAT COULD CHANGE. PENDING JURY SELECTION.

THE TRIAL IS NOW SCHEDULED FOR MARCH 4TH. REPORTING LIVE IN CABELL COUNTY, DAVE BENTON EYEWITNESS NEWS.

HEY, GUYS...YEAH WE ARE DOWN HERE IN KANAWHA CITY KEEPING A CLOSE EYE ON A BRUSH FIRE THAT'S BEEN GOING ON FOR AWHILE...

ABOUT 2:00 AM WEDNESDAY MORNING...A CALL WAS MADE IN REGARDS TO SMOKE AND FLAMES BEING SEEN FACING ROUTE 60 NEAR CAMPBELLS CREEK. THE CAUSE OF THIS FIRE IS STILL UNDER INVESTIGATON, BUT LUCKILY NO STRUCTURES ARE IN IMMEDIATE DANGER AT THIS MOMENT. NOW THE DIVISION OF FORESTRY LITERALLY PAVED A WAY THROUGH THE WOODS WITH A BULLDOZER TO GET CLOSER TO THIS FIRE...THIS WAS UP WILEY ROAD ALONG CAMPBELLS CREEK. EARLIER TODAY...WE SPOKE WITH TOM OXLEY, WV DIVISION OF FORESTRY SUPERVISOR...AND HERE'S WHAT HE HAD TO SAY....

(TOM OXLEY, KANAWHA COUNTY FIRE FORESTER) "TERRAIN DOESN'T DICTATE FOR US TO BE ABLE TO GET TO IT...WE HAVE TO BACK OFF AND PUT IN LINES THAT WE KNOW WILL HOLD AND WILL BE SAFE FOR US TO WORK IN TO MAKE SURE THE FIRE IS PUT OUT"

TAX PROTEST
WE'RE NOW JUST THREE DAYS AWAY FROM A SPECIAL ELECTION FOR A NEW EXCESS LEVY IN KANAWHA COUNTY.

KERA@ SCHOOL BOARD
EYEWITNESS NEWS ANCHOR KERA MASHEK JOINS US LIVE FROM THE DISTRICT HEADQUARTERS...TO EXPLAIN HOW SOME PEOPLE ARE *PROTESTING THIS PROPOSAL...KERA?

Return to Story Index

I TAX PROTEST
THE KANAWHA COUNTY SCHOOL DISTRICT AND PUBLIC LIBRARIES SAY THIS TAX LEVY IS NEEDED TO AVOID SERIOUS BUDGET CUTS...AND PROVIDE QUALITY RESOURCES FOR STUDENTS INTO THE FUTURE.

BUT SOME PEOPLE ARE NOT HAPPY WITH THE IDEA OF PAYING *ANY MORE TAXES.

    DRIVER HOLLERING "NO MORE TAXES"

A LOT OF DRIVERS PASSING UNDER THE INTERSTATE ALONG WASHINGTON STREET IN CHARLESTON SHOWED SUPPORT FOR THIS GROUP OF PROTESTORS...WHO WERE ENCOURAGING PEOPLE TO VOTE "NO" ON THE EXCESS LEVY THIS SATURDAY.

THE GROUP SAYS THIS IS THE THIRD LEVY KANAWHA COUNTY HAS ASKED FOR IN THE PAST FEW YEARS...AND THEY DO NOT THINK THE DISTRICT NEEDS ANY MORE OF THE PUBLIC'S MONEY.

AND THOSE RALLYING TODAY JUST HOPE THE PUBLIC WILL TAKE TIME TO STUDY THE PROPOSAL..AND GET TO THE POLLS SATURDAY TO MAKE THEIR VOICES HEARD.

The fact is they don't show us any indication of wanting to reduce costs. They want to always ask for more money. This is the third can't afford what we have to pay now. This is the third time they've asked for an excess levy and with this one being uncapped that's devastating to the average person who can't afford what we have to pay now.

THIS GROUP PLANS TO HOLD A DEMONSTRATION AGAIN TOMORROW ALONG CORRIDOR G.

MEANWHILE...*SUPPORTERS OF THIS LEVY FEEL IT'S NOT BEING REPRESENTED VERY WELL.

TONIGHT AT 10 AND 11...WHY THEY SAY VOTERS SHOULD APPROVE THE MEASURE.

LIVE IN CHARLESTON, KERA MASHEK, EYEWITNESS NEWS.

PETE THAW
THE PRESIDENT OF THE KANAWHA COUNTY SCHOOL BOARD HAS BECOME ONE OF THE MOST VOCAL *OPPONENTS* OF THE PROPOSED LEVY.

I HAVE MY OPINIONS AND I AM CONVINCED IT IS FAR TOO MUCH!

PETE THAW HAS TAKEN TO THE AIRWAVES TO TELL VOTERS TO VOTE "NO" ON SATURDAY.

IN THE RADIO AD, THAW SAYS THE SCHOOL BOARD NOT ONLY DOESN'T NEED THAT MUCH MONEY, BUT THEY ALSO HAVE NOT BEEN FORTHRIGHT ABOUT WHERE IT'S GOING .

THIS WHOLE THING HAS BEEN BUILT ON DECEPTION... THIS IS A VERY EXPENSIVE LEVY AND THEY HAVE YET TO TELL YOU WHET THEY'RE GOING TO DO WITH THE MONEY.

SUPPORTERS OF THE LEVY SAY THE SCHOOL SYSTEM NEEDS THAT MONEY TO OPERATE MORE EFFICIENTLY WITH EMERGING TECHNOLOGY, AND THE LIBRARY DESPERATELY NEEDS THAT MONEY JUST TO STAY OPEN...

DON'T FORGET SATURDAY IS ELECTION DAY...THE POLLS WILL BE OPEN FROM 6:30 A.M. TO 7:30 P.M.

NELLIS MINE ANNIVERSARY
70 YEARS AGO TODAY - 11 MEN DIED IN THE WORST MINING DISASTER IN BOONE COUNTY HISTORY.

TODAY, EYEWITNESS NEWS REPORTER LESLIE RUBIN WAS THERE AS A COMMUNITY IS STILL FEELING THE EFFECTS. SHE'S LIVE IN THE STUDIO WITH MORE...

LESLIE @ KIOSK
...THE SMALL COMMUNITY OF NELLIS TODAY AND NELLIS 70 YEARS AGO IS LIKE NIGHT AND DAY. MOST OF THE PEOPLE HAVE LEFT - AND THE SCENERY HAS CHANGED - BUT THE EMOTIONS OF THE NELLIS NUMBER 3 MINE EXPLOSION ARE STILL VERY REAL....

TODAY - DOZENS CAME TOGETHER TO REMEMBER THE 11 MEN KILLED AT THE NELLIS NUMBER 3 MINE IN 1943. THE EXPLOSION APPARENTLY HAD BEEN CAUSED BY A SPARK FROM A COAL-CUTTING MACHINE WHICH IGNITED A POCKET OF GAS IN THE SECTION WHERE THE 11 MEN WERE WORKING. THE MINE WAS OPERATED BY ARMCO AT THE TIME. THE COMPANY MOVED OUT OF NELLIS SHORTLY AFTER THE EXPLOSION - TAKING WITH IT MANY OF IT'S PEOPLE AND BUSINESS. BUT NELLIS STILL MEANS SO MUCH TO SO MANY PEOPLE - WHICH WAS EVIDENT AT TODAY'S CEREMONY. MANY WHO CAME BACK TO PAY TRIBUTE TO THE FALLEN MINERS, INCLUDING MANY FAMILY MEMBERS OF THOSE KILLED 7 DECADES AGO.

TONIGHT AT 10 ON EYEWITNESS NEWS, WE TAKE A LOOK BACK AT THE EXPLOSION AND HOW IT FOREVER CHANGED THE SMALL TOWN IN BOONE COUNTY.

TRICK SHOTS
IT'S ALWAYS FUN TO WATCH SOMEONE PICK UP A GUN AND MAKE SOME TRICK SHOTS.

EYEWITNESS NEWS ANCHOR PATRICK MCMURTRY INTRODUCES US TO A COUPLE OF BROTHERS WHO TAKE THAT TO A WHOLE NEW LEVEL IN THIS WEEK'S WEST VIRGINIA WILDLIFE REPORT

Trick shooting has been around since guns were invented, but recently a couple of men pioneered a whole new level.

But all that cost a lot of money and their wives suggested they get sponsors and literally take their show on the road. They shoot all over the world and recently wowed the crowd at the National Hunting and Fishing Days. If this gets you fired up to try shooting, Steve has a final word of advice.

19:36"If you're just getting into it, it's like any sport, you need to put in the time and the practice. one of the biggest things that can help new people get into the shooting sports is finding someone to mentor them, bring them out to the range and show them the fundementals and getting them on birds. If you just go out and shoot, you could be holding the gun wrong, you'll miss, it can get pretty frustrating."

But once you get it down, you have it down for life. For WVWL PM EWN
