from Eyewitness News Online Appeals court upholds contempt citation August 19, 2008 11:36 AM LOUISVILLE, Ky.
A state appellate court has upheld a lower court judge's ruling that found former Corrections Commissioner John Rees in contempt for not releasing an inmate on a court order. The Courier-Journal reported Tuesday that the Kentucky Court of Appeals upheld the contempt order and $500 fine issued to Rees by Jefferson Circuit Court Judge Judith McDonald-Burkman. Rees refused to release Daniel Ottman on shock probation, despite a court order to do so. The issue is whether state statute allows shock probation for a juvenile convicted of a violent crime. The release is not allowed for adults found guilty of violent offenses, but the court granted it to Ottman, who was sentenced after he turned 18. Ottman was 15 years old when he was arrested, then convicted of first-degree assault for shooting a man in September 2004. Information from: The Courier-Journal, http://www.courier-journal.com |
