Kanawha County Prosecutor Arrested After Allegedly Violating Protective Order

CHARLESTON, W.Va. (Kennie Bass) - Kanawha County Prosecutor Mark Plants surrendered to West Virginia State Police after learning he was wanted on a misdemeanor charge of violating a protective order.

Mark Plants and his ex-wife have been embroiled in a dispute after she alleged he used excessive discipline on one of their two children.

She was granted the protective order after making the accusations. It mandates that Mark Plants stay away from Allison Plants and their two children.

However, he says they had a chance encounter and that is what led to his arrest.

"Last night I walked out of Fruth, my kids were unattended in a vehicle," Mark Plants said. "It was dark. I stood with them until my ex-wife came back out. At this point that's the basis of the allegations. That is why I was arrested."

The criminal complaint says Mark Plants questioned his ex-wife about who was babysitting their children while she was at work, and that Allison Plants indicated she was scared of him.

Kanawha County Magistrate Kim Aaron gave the prosecutor a $2000 personal recognizance bond and he was immediately released.

Previously, Mark Plants has said that he and his ex-wife agreed that spanking was an appropriate form of discipline for their children.

He said it was not a problem until he divorced and re-married.

Although Mark Plants was arrested for allegedly violating a protective order, no charges have been filed on the allegations of excessive discipline.

A special prosecutor has been appointed to look into those accusations.
