The West Virginia Supreme Court has upheld the conviction and sentence of Ethan Chic Colbert.
He was at the center of a case that drew national attention when Jahlil Clements, 11, was hit and killed on the interstate, allegedly trying to get help for his mother who was being beaten by Colbert.
Colbert was sentenced last year to three to 30 years in prison for child neglect resulting in death and two other counts of child neglect creating risk of injury, for two other kids in the car. His attorneys appealed to the state's highest court, saying Kanawha Circuit Judge Duke Bloom imposed an illegal sentence that did not conform with state law. They argued that Colbert should have received a sentence of one to three years and acquitted on the charges involving the other children.
But Monday the Supreme Court dismissed Colbert's appeal.
