The man accused of shooting an off-duty Glasgow police officer was in court Friday.
Nicky Smith appeared for a status hearing.
The court intends to enter a habias corpus directing smith to be released from federal custody and taken to Sharp Hospital in Huntington to prepare him to stand trial.
The court entered a previous order finding him incompetent based on expert opinion.
At this time, Smith remains in federal custody.
He is accused of shooting Officer Steve Smith in December 2011.
