Workers who handle thoroughbreds at a West Virginia racetrack object to oversight by the state Lottery Commission.
The Racing Commission voted last month to approve an agreement that shifts various regulatory duties to the lottery agency.
The Charles Town Horsemen's Benevolent and Protective Association asked the state Supreme Court to void that agreement in a Monday filing.
The agreement assigns such legal tasks as interpreting racing laws and drafting legislation to a Lottery Commission lawyer. Monday's filing calls that a violation of the separation of government powers.
Those duties had been handled by a lawyer from the attorney general's office. The Charles Town group argues that the attorney general is more accountable because his is a constitutional and elected post.
State officials say they're reviewing the court petition.
