New information is coming to light in the murder case of slain Mingo County Sheriff Eugene Crum.
The prosecutor in the trial is putting together evidence for against suspect Tennis Maynard, who is accused of gunning down the sheriff in his cruiser.
That evidence may include an investigation into allegations Crum sexually assaulted a woman more than a decade ago.
Crum was never charged in the incident. State Police said it was consensual sex.
Sources involved in the investigation are not talking in detail about the potential evidence, but said including the police report would make sense during the upcoming trial of Maynard.
Sources close to the investigation and the West Virginia State Police told Eyewitness News Crum admitted to having sex with a woman in the back of a Delbarton police cruiser in December 2001, while two of his officers listened from the front seat.
It was initially reported as consensual, but the woman later checked into a
Williamson hospital, complaining of injuries related to a sexual assault. She was also legally drunk at the time.
A few months later, the woman decided not to pursue rape allegations against Crum, but State Police continued their investigation, ultimately clearing him.
After Crum was murdered, the case has drawn much attention and few people in Mingo County are comfortable talking about it.
But it seems many are still supportive of the former sheriff.
“He was a good man, had a family, worked every day hard to protect this community,”
Larry Thacker of Mingo County said. “I don't think they should pull up his past. I'm sure they have skeletons."
Maynard’s trial is set to start in October. He is scheduled to make an appearance in court on Tuesday.

A sexual assault investigation that was later dropped against Mingo County Sheriff Eugene Crum more than a decade ago could be evidence in the trial of his accused murderer Tennis Maynard.
According to the Sunday Gazette-Mail, the West Virginia State Police investigated allegations that Crum sexually assaulted a 19-year-old woman in 2001 when he served as Delbarton's police chief. The report said State Police concluded the sex was consensual and no charges were filed.
A source within the investigation told Eyewitness News during a phone interview the encounter happened in the back of a Delbarton police cruiser while two officers were in the front seat. He said the victim did say that she was raped, but later decided not to move forward with charges.
Tennis Maynard is charged with fatally shooting Crum on April 3rd.
A 2002 report on the sexual assault investigation is included on a list of potential evidence.
Maynard's attorney, Richard Weston, said the sexual assault allegations support the general nature of his defense, but wouldn't elaborate on the details.
