Man Accidentally Released From Jail, Captured In South Charleston

A man wanted for an attempted kidnapping is back in jail after accidentally being released. Jeremy Carter was arrested in South Charleston a little after 6 p.m. Monday after a tip lead police to a home on Riverside Drive.

"We can sleep better at night knowing that all of our kids are safe," Alexsandra Kidd says. Kidd says Carter tried to kidnap her young daughter last October while they were on their way to a park in South Charleston. Kidd says Carter followed them, yelling at her daughter, claiming he was his daughter and then tried to grab her out of her stroller once they arrived at the park. Kidd says her daughter was strapped into the stroller and Carter took off and was later arrested.

After Carter's re-arrest, he told our Eyewitness News cameras that he didn't try to kidnap anyone and he thought the girl was his daughter.

He was in the South Central Regional Jail awaiting trial on the attempted kidnapping charge but Kanawha County Circuit Judge Carrie Webster dismissed one of the case numbers associated with Carter's case and last Thursday, the circuit clerk's office sent an order to the jail for Carter to be released.

Judge Webster initially took full responsibility for his release but then released a statement saying the circuit clerk misinterpreted her order. Circuit Clerk Cathy Gatson says her office handled the case the same way they do all the others.

"Every case has multiple numbers assigned to it and any one of those numbers is directly linked to that case and any order entered on a case number will obviously affect the underlying case and that's what happened here," Kanawha County Prosecutor Mark Plants says.

Judge Webster also inadvertently dismissed a kidnapping case against Gary Wayne Mullins, he had already been convicted of the crime and was in prison so that was quickly fixed. Plants says his office is reviewing all the cases recently dismissed by Webster.

Gatson says the circuit clerk's office is in place to assist the circuit court judges and they are reviewing the situation and will make any changes recommended by the judges.




The man who was accidentally released from jail on Thursday has been captured in South Charleston.

Jeremy Carter is facing a charge of attempted kidnapping but was released from the South Central Regional Jail after Judge Carrie Webster dismissed one of the case numbers in his case. The Circuit Clerk then issued a release order for Carter although Webster says that was not her intention.

Several police agencies had been searching for Carter since his unintentional release. South Charleston police officers arrested him just after 6pm Monday evening at a house on Riverside Drive after receiving a tip.
