Some taxpayers in the Eastern Panhandle are challenging the state's exclusion of solar energy from an alternative energy tax credit.
A 2011 law allows the credit for alternative-fuel motor vehicles and refueling infrastructure.
John Christensen with Mountain View Solar in Berkeley Springs said the State Tax Department ruled last October that solar energy wouldn't be included under the law's credits.
Christensen told The Journal that several people are appealing the decision.
Christensen said his company has a lot of clients who expected to receive the tax credit. They would take a financial hit if they have to pay back taxes.
An environmental group, Sustainable Shepherdstown, is circulating an online petition that asks Gov. Earl Ray Tomblin to instruct the tax department to include solar energy in the law.
