Home confinement officers found the phone in Robert Lutsy's house. As part of his eight year home confinement deal, Lutsy is not allowed to have a computer or a smart phone, but the judge said prosecutors did not make it clear that the ban applied to family members.
He told them to re-draft the rules to make them clearer. Meanwhile, Lutsy will be allowed to remain on home confinement. Family members have turned in their iPhones until they are sure what is okay.
