The murder retrial of Rhonda Stewart was pushed back Wednesday in Kanawha Circuit Court to next year over prosecution objections.
It had been set for Oct. 9. Stewart’s lawyer needed more time for a defense firearms expert to examine the gun that killed her husband. Stewart shot and killed her husband in his bed in the intensive care unit at a Charleston hospital.
Stewart was convicted of first-degree murder with mercy, but won a new trial because Judge Tod Kaufman had barred the use of the battered wife defense. Prosecutors note that Stewart will receive credit for time served on home confinement if she is convicted again.
Stewart returns to court Sept. 17 to pick a trial date in the January term.
