Thomas Shea, 49, of Charleston was arrested early Wednesday morning.
Corporal D. Nikocevic was responding to call of man setting small fires at Shea's Randolph Street apartment building around 2:30am. That's when a flaming newspaper thrown from the 2nd floor missed Nikocevic by a couple of feet.
Police now say the charges may be dropped if they determine mental health issues are involved.
