A Kanawha County magistrate will remain suspended without pay until ethics allegations against her are resolved.
The West Virginia Supreme Court on Tuesday refused to alter the April order it issued against Magistrate Carol Fouty.
Ethics investigators allege she accepted favors in exchange for dropped charges. The court's Judicial Hearing Board has set an Aug. 8 hearing for the five ethics counts against her.
Fouty petitioned the justices asking to be allowed to return to work. A lawyer for Fouty argued during a hearing last week that the suspension was placing a financial hardship on her.
Tuesday's unanimous decision concludes that Fouty's alleged misconduct threatens the judicial system's integrity and honor. The court said that warrants suspending her without pay.
