Federal Judge Overrules Beating Case

A Federal Judge has overruled a beating case involving a Wood County Sheriff's Deputy.
Judge Joseph Goodwin said Deputy Jim Asbury did use excessive force while Brian Sawyer was being detained.
In 2010, Sawyer was arrested following a domestic violence call and taken to the police station.
Security camera footage shows Asbury violently grabbing Sawyer around the throat, choking him, and pulling his arm back.
A jury had previously ruled Asbury did not use excessive force.
